our value chain. Our patent portfolio stands out as the most substantial
portfolio in the biochemical profiling (metabolomics) and small molecule diagnostics
industries.
Metabolon, Inc. Patents and Patent Applications
Metabolon's patent portfolio is comprised of over 100 US and worldwide patents and
patent applications, including pioneering patents in the field of metabolomics.
Our data analysis and software patents cover critical aspects of our metabolomics
platform, including collection and analysis of the massive amounts of data generated
by metabolomics experiments and the identification of small molecules comprising
complex mixtures. In addition, Metabolon has pending patents directed to small molecule
biomarkers related to drug action, toxicity, carcinogens, aging and numerous diseases
and disorders.
In 2007, Metabolon, Inc. acquired the metabolomics-related patent estate from Cogenics
Icoria, a subsidiary of Clinical Data, Inc. The estate includes issued and pending
patents related to data analysis and software as well as biomarkers of toxicity
and carcinogenicity.

The early, pioneering patent applications, referred to as the Daouk-Kristal patent
family, provide fundamental IP in the field of metabolomics. Metabolon, Inc. is
the assignee of this patent family and has an exclusive license from Cornell University.
The Daouk-Kristal patent family gives Metabolon, Inc. an important competitive advantage
and exclusivity with respect to using metabolomics for drug discovery, disease treatment
and diagnostics. To date, five patents related to using metabolomics for identification
of biomarkers for disease have issued from this patent family.
Our initial patent prosecution focus has been on the use of metabolomics methods
to identify small molecules that are indicative of disease states (i.e. biomarkers).
Five US patents related to employing metabolomics to identify disease-associated
small molecules have been issued to date. The broadest patent claims use of metabolomics
for identification of biomarkers of any disease state. Other patents claim specific
disease states such as the nervous system disorders Amyotrophic Lateral Sclerosis
(ALS), Alzheimer's Disease, Parkinson's Disease, Huntington's Disease, depression,
and schizophrenia; oncological disorders; and metabolic disorders (e.g. pre-diabetes,
insulin resistance, cardiovascular disease, etc.). These issued, allowed and pending
patents provide Metabolon, Inc. with a very strong IP position in small molecule
biomarker identification for diagnostics.
Several additional patents directed to the use of metabolomics beyond biomarker
identification and diagnostics are pending in this portfolio. These patents are
in the areas of drug response, monitoring drug and treatment efficacy, chemical
agent (drug, toxin) toxicity evaluation, drug repositioning, determining predisposition
to disease, identifying gene effects (native and trans-genes), and drug target identification.
Metabolon, Inc. has built an IP portfolio of enabling technology patents comprising
our Metabolomics Analytical Platform, Data Curation Methods and Analysis Software
Systems. These pending patents represent 'stepping stone' techniques, providing
solutions to analytical challenges that accompany metabolomics experiments and the
massive amounts of data generated. Our technology patents are directed toward unique,
robust analytical methods to determine the composition of small molecules in complex
samples, employing forward thinking means of data analysis and small molecule identification
that is high-throughput, automated, precise and accurate.
The company was awarded two patents for its proprietary metabolomics software. US
Patent 7’433’787, titled "A System, Method, and Computer Program
Product Using a Database in a Computing System to Compile and Compare Metabolomic
Data Obtained from a Plurality of Samples" ( Visual PHIL™), provides
analysis and a unique visual display of metabolomic data. The software enables the
analysis of a series of raw and complex data sets being generated from a variety
of instruments into one comprehensive visual display that can indicate the presence
of the selected metabolites across a group of samples. US Patent 7’561’975,
titled “A System, Method and Computer Program Product for Analyzing Spectrometry
Data to Identify and Quantify Individual Components in a Sample” (IonTracker™),
provides a mechanism for creating new chemical library entries.
The Metabolon, Inc. biomarkers and diagnostics portfolio is comprised of small molecules
that are indicative of specific diseases and the uses thereof. Patents are pending
on biomarkers and the uses thereof for more than eight diseases including ALS, Alzheimer's
Disease, depression, prostate cancer, non-alcoholic steatohepatitis, metabolic syndrome,
insulin resistance and cardiovascular diseases. These patents claim the use of the
biomarkers for prognostic and diagnostic uses as well as for therapeutic uses, drug
screens and target discovery, monitoring treatment effects and efficacy, and monitoring
disease progression/regression. The portfolio also contains pending patents directed
to biomarkers of toxicity and carcinogenicity as well as biomarkers indicative of
drug response. Further, the Daouk-Kristal patents provide Metabolon, Inc. with IP
in the use of metabolomics to identify biomarkers.
